TERMS & CONDITIONS

Welcome to the Lo Monaco Wellness website (the Website) Terms and Conditions.

Lo Monaco Distribution Inc., operating as “Lo Monaco Wellness”, (“Lo Monaco Wellness”, “we”, “us” or “our”) provides the services available on the Website. Your use of this Website is governed by these Terms and Conditions set out below. By using any part of this Website, completing and sending off the Order Form, Emailing or Faxing us you agree to be bound by these Terms and Conditions.
These terms and conditions are applicable to the supply of products to the buyer hereafter referred to as the “Customer”.

PRICE 
All prices are quoted in Canadian Dollars and they do not include applicable GST and QST unless otherwise stated. Shipping & handling will be charged in addition to the price of any goods and are stated on the Order Form.

PAYMENT
Payment can be made either by Visa/Master Card or Cheques.
Cheques can only be accepted upon approval.
All payment will be processed and cleared before dispatching the goods.
The Customer will be notified if their payment is not accepted or can’t be processed as soon as possible.

PASSING OF PROPERTY 
Lo Monaco Wellness retains ownership of the goods until full payment has been made by the Customer and until that payment has been cleared.

PASSING OF RISK 
The risk in the goods shall pass to the Customer on delivery.

DELIVERY 
All goods are sent by major couriers or transport companies, Monday to Friday only.
Depending on the areas, please allow 3-7 business days.
A signature will be required for your goods unless you state otherwise on your Order Form.
Only for Dr.Vranjes room fragrances we can’t accept Overseas Orders.
Lo Monaco Wellness can’t be held responsible for delays in the delivery caused by their distributors or any other third party.
Lo Monaco Wellness is not responsible for returned goods that do not reach us or their cost therefore the Customer is advised to return any goods by registered post.
Lo Monaco Wellness will refund/exchange goods where they have been damaged/ faulty/ incorrectly supplied providing you notify us within 24 hours of their receipt by either phone or email and the goods are returned to the distributor together with the original packaging within 7 days of receipt.
Shipping and Handling costs are not refundable unless the goods are faulty or incorrect.
If the goods arrive and the Customer believes the package has been either tampered with or there are obvious signs
of damage, it is the Customers responsibility to refuse to sign for the goods.

ACCEPTANCE 
The Customer shall inspect the goods within a reasonable time period after their receipt and shall be deemed to accept the goods unless they notify Lo Monaco Wellness within 7 working days that the goods are not acceptable. This does not however affect the Customers statutory rights.

RETURNS PROCEDURE
 
If you are dissatisfied with your order you may return it to us within 7 working days, in its original condition, for a full refund or replacement.
In the event of your order arriving damaged or you did not receive the product(s) you requested, then please contact us within 24 hours either by E-mail, Fax or Phone and we will replace damaged or incorrect orders upon receipt of the faulty or incorrect products, with their original packaging.

CANCELLATIONS 
The Customer can cancel their Order without any cost providing the goods have not been dispatched.
If the goods have been dispatched then the Returns Procedure will apply.

LAW 
These terms and conditions are governed and shall be interpreted in accordance with Quebec Law. Any person who makes a fraudulent credit card or cheque transaction will be prosecuted with no exception.

COMPLAINTS 
If you wish to complain about any matter in respect of the goods please contact Lo Monaco Wellness by either e-mail, telephone or fax.

GENERAL 
All prices stated on the Website are the only official ones set by Our suppliers.
Lo Monaco Wellness will not be responsible for higher prices set by our Customers.
While Lo Monaco Wellness uses reasonable endeavors to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness.
Lo Monaco Wellness will not be responsible for any errors or omissions or for the results arising from the use of such information.
Lo Monaco Wellness takes all reasonable steps to ensure a fast and reliable service, it does not guarantee deliveries by use of this website and cannot be held responsible for your use of this website and that it will be interruption or error free and will not be responsible for any disruption, loss, corruption of any material in transit, or loss of or corruption of material or data when downloaded to any system.

The entire liability of Lo Monaco Wellness for direct loss under or in connection with any contract for any products to which these terms and conditions apply shall not exceed the price of the products, except as expressly provided in these terms and conditions.

Lo Monaco Wellness does not accept liability for any consequential or incidental damages that arise out of or are related to the use of this site or the purchase or use of any goods.

Lo Monaco Wellness reserves the right to make changes to any part of the site. By using the site following any changes to the terms, you agree to be bound by those changes.
